These Terms of Service (“Terms”) govern your access to and use of the websites, hosting, domain registration, web design, maintenance, and related services provided by WebFoxHost (“WebFoxHost,” “we,” “us,” or “our”). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
WebFoxHost provides cloud, reseller, and VPS hosting, domain registration and management, website design, and ongoing maintenance and support. The specific services you receive, along with their scope and price, are described in the order, proposal, or plan you select. We may add, modify, or discontinue features from time to time to improve or maintain our services.
To use certain services you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at admin@webfoxhost.com if you suspect any unauthorized use. You must be at least 18 years old, or the age of majority in your jurisdiction, to open an account.
You agree to pay all fees for the services you order at the rates in effect when you subscribe. Unless stated otherwise, services renew automatically at the end of each billing cycle, and we will charge your payment method on file. It is your responsibility to keep that information up to date. Fees are non-refundable except where required by law or expressly stated in a specific plan. We may change our prices with reasonable advance notice, effective on your next renewal.
Domain registrations are subject to the policies of the relevant registry and ICANN, as well as any applicable registration agreement. You are responsible for providing accurate registrant contact details and for renewing domains on time. We are not liable for the loss of a domain resulting from expiration, inaccurate information, or a dispute governed by the Uniform Domain-Name Dispute-Resolution Policy (UDRP).
You agree not to use our services to store, transmit, or distribute unlawful, infringing, harmful, or malicious content; to send spam or engage in phishing; to gain unauthorized access to systems or data; to distribute malware; or to interfere with the operation of our network or other customers. We may investigate suspected violations and take appropriate action, including suspension or termination.
You retain ownership of the content and materials you provide to us or host on our services. You are solely responsible for that content and for ensuring you have the rights to use it. You grant us the limited license necessary to host, display, and process your content in order to provide the services. You are responsible for maintaining your own backups unless a backup service is expressly included in your plan.
All software, designs, trademarks, logos, and other materials that we own or license remain our property or that of our licensors. Except for the rights expressly granted to you, nothing in these Terms transfers any intellectual property rights to you. Custom deliverables produced for you are governed by the terms of your specific project agreement.
Our services may rely on or link to third-party products, platforms, or providers. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is subject to that provider’s own terms.
Our services are provided on an “as is” and “as available” basis. While we work hard to keep our services reliable and secure, we do not warrant that they will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, WebFoxHost will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of or inability to use our services. Our total liability for any claim relating to the services will not exceed the amount you paid us for the service in the twelve months preceding the claim.
You agree to indemnify and hold harmless WebFoxHost and its owners, employees, and affiliates from any claims, losses, or expenses (including reasonable legal fees) arising from your content, your use of the services, or your violation of these Terms or applicable law.
You may cancel your services at any time in accordance with your plan. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the services in a way that harms us, our network, or others. Upon termination, your right to use the services ends, and we may delete associated data after a reasonable period unless retention is required by law.
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
